- 4. USCIS Interview: In some cases, your fiancé may require to attend an interview at a U.S. embassy or consulate in their home country. The interview is a crucial step for the approval, so it's important to be well-prepared.
- 5. Reunion and Green Card: Upon arrival, your fiancé will be admitted to the U.S. for a temporary period. You must marry within 90 days and then apply for a green card.
- 6. New Life Chapter Together: Once your fiancé has a green card, you can focus on building a happy and fulfilling life together in the United States.
Can we apply for a Fiance (K-1) Visa if same-sex marriage is illegal in my partner’s home country?
Yes. This is one of the most common reasons LGBTQ+ couples choose the K-1 Fiance Visa over a Marriage Visa. Since the marriage must take place in the U.S. (where same-sex marriage is federally recognized) within 90 days of arrival, the legal status of your relationship in your partner’s home country does not disqualify you.
What if my partner's family refuses to provide affidavits or attend our wedding?
Lack of family support is a recognized reality for many LGBTQ+ applicants and does not de-legitimize your visa case. If a USCIS officer asks why your in-laws aren’t in your photos, the best policy is radical honesty: explain the cultural or familial homophobia involved.
My partner’s passport has a gender marker that doesn’t match their identity. Will this cause a visa denial?
No, it will not cause a denial, but it does require careful synchronization. USCIS and the Department of State allow you to select the gender you identify with on immigration forms, regardless of what is listed on the foreign passport or birth certificate.
