How to get a Waiver Approval?
To remove conditions on your permanent residence jointly with your spouse, you must file Form I-751, Petition to Remove Conditions on Residence, together during the 90 days before your 2-year conditional green card expires.

When Can You Request a Waiver?
To get a waiver approval for the removal of conditions on your green card (Form I-751), you must apply for a waiver of the joint filing requirement if you’re no longer married to your U.S. citizen or permanent resident spouse, or if other exceptional circumstances apply. You can file Form I-751 without your spouse if:

- Divorced or annulled after a good-faith marriage.
- Abused or battered by your spouse or their family.
- Extreme hardship would occur if removed from the U.S.Â
- 1. Who qualifies?: Confirm you are a conditional permanent resident (2-year green card holder) and are still married to the spouse who sponsored you.
- 2. Gather Supporting Documents: Submit evidence proving your marriage was entered in good faith and is genuine including joint finances, lease, utility bills, photos together, or any other evidence.
- 3. File Form I-751 jointly with your spouse (the one through whom you obtained conditional residence) within the 90-day window before your conditional status expires to avoid losing permanent resident status
- 5. USCIS removes the conditions and you receive your 10-year permanent resident green card.
- 1. Who qualifies?: You may qualify for a waiver if you entered your marriage in good faith but are now divorced, widowed, abused, or would face extreme hardship if removed from the U.S.
- 2. Gather Supporting Documents: Include strong evidence like proof of a genuine marriage, divorce or annulment papers if applicable, records of abuse such as police or medical reports, and documents showing the hardship you would face if removed.
- 3. Prepare Form I-751: File Form I-751, checking the appropriate waiver box.
- 4. Biometrics Appointment and/or Interview: Attend your biometrics appointment when scheduled or interview until you receive a decision.
- 5. USCIS removes the conditions and you receive your 10-year permanent resident green card.
